JOB SUMMARY:

CRIMINAL PROSECUTOR FOR THE THREE AFFILIATED TRIBES ALSO KNOWN AS THE MHA NATION (or Tribes).

JOB RESPONSIBILITIES:

  • Performs or assists in performing and is responsible for general prosecution of crimes, juvenile delinquency, and status offenses; prosecutes mental health and substance abuse commitment petitions; prosecutes and/or participates in the Tribes’ Wellness Court; and prosecutes and/or participates in other matters as provided by the Tribes’ Code of Laws
  • Develops, issues or directs or assists in developing, issuing, or directing issuance of court documents including, but not limited to, subpoenas, warrants, summons, writs, judgments, decrees, post-trial motions and appeals
  • Prepares or assists in preparing for court proceedings including but not limited to arraignments, bench, jury, and sentencing trials
  • Communicates and coordinates or assists in communicating information and coordinating work on case status with all involved parties such as defense attorneys, U.S. Attorneys, Federal Probation Dept., Tribal Probation Dept., police officials, and victims
  • Participates or assists in participating in the drafting of Resolutions and Ordinances and presents written and oral legal information to the MHA Nation Judiciary Committee and Justice Commission, as requested
  • Performs or assists in performing other duties and undertakes responsibilities inherent to the position of an Assistant Criminal Prosecutor of the Tribes
  • And other duties as assigned.

MINIMUM REQUIREMENTS:

  • Must have a Law Degree from an accredited law school and be a member in good standing with a State Bar Association OR must meet the requirements of a Legal Advocate in accordance with Tribal law, obtain a Legal Advocate’s License and be in good standing with the authority issuing the Legal Advocate’s license.
