JOB SUMMARY:

The Klamath Tribes governing body (the Klamath Tribal Council) shall select and appoint the TERO Director who will be responsible for the development of program strategic goals and carrying out the day-to-day activities of the Tribal Employment Rights Office (TERO), including implementing and enforcing rules and regulations promulgated by the TERO Commission.

JOB RESPONSIBILITIES:

  • Implement and enforce the provisions for the Tribe’s TERO Ordinance, as well as any properly adopted rules, regulations or policies promulgated by the TERO Commission.
  • 2Develop TERO Strategic Plan and executes program operational processes.
  • with Tribal programs and enterprises to devise TERO compliant procedures.
  • 4. Work in conjunction with the Tribal Career Development Program activities to promote and develop Tribal Member career advancement opportunities, workforce retention initiatives, and training programs in support of TERO objectives.
  • 5. Prepare, administer and track the department budget as approved by the TERO Commission.
  • 6. Recommend regulations, amendments and agreements.
  • 7. Investigate and process complaints alleging violations of the TERO Ordinance.
  • 8. Impose penalties or recommend remedies, as applicable, for violations of the TERO Ordinance.
  • 9. Represent TERO at Tribal Council meetings, Tribal General Council, TERO Commission hearings, and Tribal Court proceedings.
  • 10. Coordinate and provide reports for Commission hearings.
  • 11. Negotiate workforce requirements that reflect the available labor pool and the TERO fee payment schedule, if applicable, with construction contractors.
  • 12. Consult with the Tribe’s Project Manager regarding workforce requirements prior to negotiating or specifying the number of TERO workers required on Tribal construction projects.
  • 13. Ensure adherence to the provisions contained in the Klamath Tribes Memorandum of Understand with Oregon Department of Transportation (ODOT), and as it applies to ODOT contractors and subcontractors, establishing Indian preference employment requirements on ODOT projects within the defined TERO b
  • 14. Work closely with State agencies, i.e. ODOT, on State contracted projects on or near the reservation.
  • 15. Analyze and select ODOT projects for TERO participation; works with ODOT Office of Civil Rights to set TERO Indian preference hiring goals on a per project basis.
  • 16. Coordinate training and certify ODOT contractors that bid on TERO projects that are within the MOU TERO boundary.
  • 17. Negotiate and execute TERO Compliance Agreements with contractors and subcontractors on ODOT and Tribal construction projects.
  • 18. Provide education and training options, eliminate barriers and enhance employment opportunities.
  • 19. Research and make suggestions regarding new opportunities and programming.
  • 20. Disseminate TERO information and requirements to covered Tribal employers.
  • 21. Certify Klamath Tribe owned or Indian owned businesses who will be working on and near reservation projects.
  • 22. Work with Tribal programs and enterprises to ensure that TERO requirements contained in the Klamath Tribes Procurement Policy are met.
  • 23. Maintain a list of Klamath Tribal members and Indians who are local residents available for employment and assists such persons with job placement.
  • 24. Develop resources and coordinates construction trades workforce training for Tribal members.
  • 25. Conduct or coordinate on-site inspections of employers on and near the reservation to assure compliance with the TERO Ordinance.
  • 26. Maintain a database and update the list of Indian Businesses and Contractors every year to ensure they are certified or re-certified by the TERO Commission.
  • 27. Provide day-to-day supervision of assigned staff to include, but not limited to, assigning work, evaluating job performance, coaching and development, disciplinary action, hiring and termination.
  • 28. Ensure the hiring, training, promoting, assigning, disciplining and discharging of employees are in accordance with Tribal Law, including without limitation, the Tribal Employment Rights Ordinance (TERO).
  • 29. Assure staff adherence to all policies and procedures, work, safety and administrative rule, Tribal Law and State Regulations.
  • 30. Serve as a mentor, as requested, for Tribal Career Development.
  • 31. Support a safe work environment by performing all duties in accordance with Tribal safety policies and procedures, and Emergency Management Plan.
  • 32. May be called upon to serve as a Disaster Reservist during Emergencies, or when the Tribal Emergency Operations Center is opened.

MINIMUM REQUIREMENTS:

  • REQUIRED to possess a Bachelor Degree in Business Administration, or related field; emphasis in Human Resource Management in the public sector OR equivalent job-related experience may be substituted for degree. Consideration will be given to a relevant combination of education/experience equal to at least four (4) years. (Submit documentation with application.)
  • REQUIRED to have five (5) years of progressive work experience in governmental or community-based employment and development program; TERO program experience strongly preferred.
  • REQUIRED to have five (5) years of supervisory experience.
  • REQUIRED to have OSHA 10 training within 6 months of hire.
  • REQUIRED to have computer experience; emphasis will be in the use of Microsoft Word, Excel and work in a networked environment.
  • REQUIRED to possess and maintain a valid Oregon Driver’s License, (out of state applicants must receive ODL within 90 days of hire), have good driving record and be insurable by The Klamath Tribes’ vehicle insurance policy. (Must submit copy of driver license with application.)

PREFERRED REQUIREMENTS:

  • TERO experience is preferred.
  • Experience working with Native American populations, is strongly preferred.
  • Experience with State contracted projects, ODOT, is strongly preferred.
